Minutes of a Meeting held by Burton-in-Lonsdale Parish Council on Thursday 29th January 2009
between 7.30pm and 9.45pm in the Village Hall
Present: Cllrs. Burns (Chairman), Hartley, Hird, Mason, Salrein and Whitworth; District Cllr Barrington, 2 members of public.

1a. Casual Vacancy: advertisement to co-opt new council member (position vacant
following Cllr. Ford’s resignation.
Clerk reported position advertised both on public Notice Board and in forthcoming Burtonian.
2. Minutes of the Parish Council Meeting of 27th November 2008
The Minutes for the above meeting were circulated to all councillors prior to this meeting and taken as read.
The Minutes for the meeting of 27th November 2008, were accepted as a fair record, with one amendment: Cllrs. present included Cllr. Hird. The Chairman signed and dated the Minutes. Copies of the Minutes were made available for the Village Hall Notice Board.
3. Public Questions or Statements
There were no public questions or statements.
4. Matters Arising from the Minutes of 27th November 2008, if not on this Agenda:
Including Very Old and Separate Churchyard: letter from Diocesan Registrar
Lengthy discussion included citing old photographs (early 1900s) of the Village Green, showing the open area up to the Lych Gate (i.e. no fencing).
Resolved
To seek advice regarding possible level of fees involved in obtaining a solicitor’s official advice as to whether there exists a right of access through the now garden of Harris Garth, High Street (Village Green).
The Chairman moved that item 8 be brought forward for discussion, as the two members of public had attended the meeting specifically for the purpose of discussing charges for using the Recreation Field and portacabin.
8. Recreation Field
a) Play Area Maintenance
The long pole on the chain walk has been replaced; swing cross bars and walk chains not yet re-furbished; Cllr Mason to enquire.
Safety mats: Clerk to make enquiries about installation costs (resolution October 2008 to install mats under one swing to assess cost/effectiveness).
b) Charges for use of Recreation Field and portacabin
Ingleton AFC representative N Capstick reported concerns regarding recent
damage caused by ‘joy’ riders driving a car in circles on the pitch, damaging
the surface.
Resolved
IAFC to source a post that folds flat when unlocked from its upright position,
and install in gap between wooden bollards around the parking area on the
Recreation Field. Duplicate keys to be obtained to give to Clerk and official
field users.
Craven Wanderers (CW) requested the charges for utilities be reviewed: club
funds were very limited and it is very difficult to pay for matches as well as
utility costs. (the current share proposed: see page 82, minutes 25 Sep 2008)

To monitor the costs and report back to IAFC and CW.

5. Police matters
PC McClurg reported to the Clerk prior to the meeting there were no specific items to report.
6. Finance
a) Bank balances as at 19th January 2009
The Clerk presented the bank balances as at 19th January 2009 with a schedule of commitments and payments. (Appendix 1)
b) Payments of budgeted and non budgeted items, including power supply re Village Green Xmas Tree lights.

Resolved
To authorise payments on behalf of the Parish Council as per Appendix 1, including the December 2008 payment for water supply to Recreation Field portacabin.
Resolved
To offer householder who kindly allowed electric supply to light Christmas tree lights a contribution toward cost; a cheque for a maximum of £50 to be signed, if offer accepted.
c) Appointment of new Finance Committee member position vacant due to resignation of Cllr. Ford.
Resolved
Cllr A Whitworth appointed to the Finance Committee; quarterly review to be arranged.
7. Reports
County Councillor: no report.
District Councillor: Cllr Barrington reported Craven District Council seeking to make budget savings during 2009-10 e.g. more efficient bulk waste collection, discontinuing the supply of free dog waste bags, and re-consideration of introduction of car-parking charges at the Grasmere Drive car park in Bentham; CDC has written to Bentham TC suggesting discontinuing cleaning the public lavatory at Grasmere Drive, saving £6,800 per year.
A District Council representative is at Bentham Town Hall every Monday morning, to answer any questions.
Cllr Barrington also enquired if there were any comments re the planning application 15/2008/9174: proposed dwelling, 18 Low Street, Burton in Lonsdale (re-application). It was confirmed there were no comments apart from suggesting neighbours should satisfy themselves regarding the structural integrity of the proposed building.
8.50pm Cllr. Barrington left the meeting.
Parish Councillors
· Village Green ‘No Parking’ posts needs repainting & lettering: Clerk to
action.
· Chapel Lane junction has subsided again; reported to NYCC for repair
28/1/09.
· Dog dirt an increasingly obnoxious problem around the village; item to
remind owners to ‘scoop’ to go in next issue of The Burtonian.
Woodland Trust
Clerk reported woodcutting done in last couple of weeks on Mill Hill, (triangle of land between road to Greeta house and road to Greta Mount); the cut wood was taken away, contrary to normal Woodland Trust practice. Cllr Salrein stated Mill Hill does not belong to Bentham Common Lands Charity, even though a Woodland Trust sign is on the land in question; Clerk to confirm ownership after consulting council records. Clerk also to ask WT about wood that was taken away.
Bentham Common Lands Charity (BCLC)
Cllr. Mason reported the BCLC meeting of Tuesday 16th December 2008 in Burton in Lonsdale Village Hall (see Minutes appendix 2). The meeting’s Chairman, Mr. R Aitchison, appointed Cllr Salrein as a Trustee, to represent Wennington parish’s interests. Following the BCLC meeting, a letter was received from Wennington Parish Council (see appendix 3) confirming it is no longer interested in the Charity. Cllr Mason is happy for anyone to be appointed a trustee, provided they are appointed correctly; Cllr Salrein’s appointment would be useful, due to her long experience of the area; however it appears Cllr Salrein has not been appointed correctly. Cllr Mason expressed doubt regarding Cllr Salrein’s appointment on the basis of representing Wennington Parish, and was unhappy about the meeting’s acrimonious conduct: her question as to who are the Trustees being put three times and remained unanswered. Cllr Mason considered the meeting to be inconclusive, not serving the interested parishes properly and looks forward to a more proactive meeting

Village Hall Cttee
Cllr Salrein reported the new audio system had been damaged, and is being repaired. It was noted the controls have been moved higher, away from children’s reach. But the wiring continues to be of concern. Grants applications for funding of roof insulation are being made.
Clerk: Village Shop request for written support re application for a bus shelter.
Resolved To write a letter of support for the proposed bus shelter/shop canopy.
9. Riverside Land Maintenance
Review of maintenance policy re trees, grass cutting, grass verge.
Following a parishioner’s request for some tree branches to be cut down to facilitate a better television signal during summer, there have been two inspections, by a television engineer accompanied by the Clerk, and the Clerk and parishioner. A lengthy discussion regarding the merits of either the Parish Council or the parishioner paying for the work ensued, as the work would benefit only one household.
Proposed
The Parish Council pays for the work.
Cllr. Hird requested her opinion be noted: she does not support the proposal that the resident should pay for the work.
Vote: 1 vote for, two abstentions, 3 against. Not carried.
Proposed
To give permission for the work to be done by the parishioner at his own expense, before Spring/leaf burst.
Vote: 3 for, 1 against, 2 abstentions. Carried.
Clerk to write to parishioner; Riverside maintenance programme to be discussed at February meeting.
10. Craven District Council
a) Planning applications, decisions and enforcements, including applications to Environment Agency , and including: Enforcement: Southfork, Longber Lane, Burton – removal of temporary static caravan by 1st May 2009;
Application: 15/2008/9300: change of use & conversion of barn to dwelling with B&B & holiday let, Lund Farm, Westhouse, Ingleton, LA6 3PF.
Resolved The Council notes there are already a substantial number of holiday let premises in the area; however, it has no objection to the proposed application.
b) Local Development Framework; monthly update: noted
c) Annual Parish Meeting (to be held between 1st March and 1st June) this item was noted for the February meeting.
11. North Yorkshire County Council
a) Traffic Speed Survey results; further action
Clerk circulated a summary of traffic speed survey results from 2004, 2006 and 2008. The general trend was a decrease in overall speeds immediately following the traffic calming measures (2006), and an increase back to the 2004 levels in 2008. (see appendix 4).
Resolved
Clerk to write to NYCC and Police drawing attention to survey results and requesting advice as to how to reduce traffic speeds through the village.
b) Minerals and Waste Development Strategy consultation minutes noted
c) Community Waste Warriors: request for volunteers to be trained: noted. (Clerk has circulated to parish).
d) Highways Agency: A65 (between M6 J34 and A59) detrunking order 2008
The Order was noted.
12. Barnoldswick Town Council (Lancashire) request to support its resolution passed on 3rd December 2008:
“That this town council notes with
considerable concern the continuing crisis in hospital services since the
implementation of the “meeting patients' needs” programme in East Lancashire
and the consequent closure of the Accident and Emergency department at Burnley
General Hospital and the transfer of services to Blackburn. Council notes the
awful affect that this deterioration in services is
having on local people attending both Blackburn and Airedale A&E
departments, with those departments being stretched to and, at times, beyond
the limit. Accordingly, council resolves to
1. Make the strongest possible protest to the Secretary of State for Health
about the present position and demands the reopening of Burnley’s Accident and
Emergency department.
2. Request the support of Pendle MP Gordon Prentice for such re-opening.
3. Inform all parish and town councils in Pendle and Craven Districts of the
terms of this resolution and request that they be requested to pass a similar
resolution and put further pressure on the government to act on this
issue."
The Parish Council noted the request for support, but felt it was note able to do so, as Burnley General Hospital was not in the immediate vicinity.

Minutes of Bentham Common Lands Charity meeting
held 16th December 2008

Minutes of the Meeting of the Bentham Common Land Charity Trustees on Tuesday 16th December 2008 at 10.00am at the Village Hall. Burton-in- Lonsdale.
Present: Mr R.Aitchison, Chairman, Mrs K.Salrein, Mrs M.Mason, Mr B.Wills.
Apology; Mrs P.Tomlinson.
1. New Appointments/Trustees
The appointments of Mrs M. Mason and Mr B. Wills were formally confirmed as representatives for Burton-in-Lonsdale and Bentham respectively. Trustees were informed that the Trustee Update Form had been completed and returned to the Charity Commission, together with a request for a copy of the form for records. It was also agreed to send letters of appreciation to Mr Marshall and Mrs Salrein for the years of service they had given on behalf of the Trust. Mrs Salrein agreed to be a Co- opted Trustee and her extensive local knowledge/history of the Burton-in-Lonsdale parish
affairs would prove beneficial &helpful to the Trust.
2. Chairman’s Appraisal/Comments on the Trust.
Mr Aitchison gave an overall review of the activities of the Trust primarily for the benefit of the two new members and was ably supported by Mrs Salrein. Originally, the Trust comprised Bentham, Burton-in-Lonsdale, Ingleton and Wennington, although representation of the latter parish ceased -at their request-several years ago. Other topics covered sale of two areas of land viz; Sweetlow Whins Quarry and Linghaw Cross from which the concerned parishes benefited financially. The Trust has been established over 30 years and the two remaining parcels of land at Birkwith
Common and Mill Hill are leased/managed by the Woodland Trust on a 99 years agreement.

Dear Mrs. Gregory,
Bentham Common Land Charity was discussed at Wennington Parish Council meeting yesterday evening.
Mr. Eric Atkinson, who was a Parish Councillor in 1988 when the Charity was set up, spoke about what was discussed at that time. He said that the land on Ravensclose Lane, Wennington is opposite Goodenbergh caravan site (it is in Yorkshire, not in Wennington Parish) this old quarry has been used for a tip and is now filled in and grassed over.
I have been instructed to inform the Parishes of Burton in Lonsdale, Ingleton and Bentham that Wennington Parish Council no longer has an interest in the Charity.
